Exploring human development: a challenge to the incapacitative-essentialist duo in american criminal justiceMy thesis explores how the juxtaposition of the Incapacitative theory of punishment and Psychological Essentialism (Incapacitation Essentialism Duo model) offers a new lens with which to analyze and interpret the American penal system. In addition, it presents an empirical objection to the IED model by challenging the static view of the person on which the IED model is grounded. Finally, it addresses a legal and philosophical reflection on the implications of scientific findings on human development in the field of punitive practice of criminal justice involved people.
